Petition to End the Second Amendment Poll Tax in Texas
To: Governor Abbott, my State Senator & my State Representative
WHEREAS, the right to keep and bear arms is a natural, God-given right guaranteed by the Second Amendment — not a privilege that can be taxed or restricted by government; and
WHEREAS, Texas currently imposes a sales tax on firearms, ammunition, and accessories, forcing law-abiding citizens to pay a fee simply to exercise their constitutional rights, amounting to nothing less than a modern-day poll tax on the Second Amendment; and
WHEREAS, other states such as Florida have already acted to reduce or eliminate these financial burdens — demonstrating that states can take bold steps to defend the rights of gun owners — yet Texas has failed to do the same, despite its reputation as a pro-gun state; and
WHEREAS, Texans should never be forced to pay a tax in order to defend their lives, their families, or their homes, and continuing to impose such taxes is an unconstitutional infringement that penalizes citizens for exercising their most fundamental freedoms;
THEREFORE, BE IT RESOLVED that we, the undersigned, demand the Texas Legislature take immediate action to end the sales tax on firearms, ammunition, and accessories and abolish this unconstitutional poll tax on the Second Amendment once and for all. Texas Gun Rights will keep me informed of your actions.
Message from the President
Fellow Patriot,
The right to keep and bear arms is not a privilege granted by politicians — it’s a God-given right guaranteed by the Constitution.
But here in Texas, gun owners are still being forced to pay a sales tax every time they buy a firearm, a box of ammunition, or even basic accessories. That’s not just unfair — it’s nothing less than a poll tax on the Second Amendment.
Other states are already taking action: Florida recently passed a sales tax holiday on firearms and ammunition — proving that states can ease the burden on law-abiding gun owners when they have the political will to do so. If Florida can take this stand, what excuse does Texas have?
Texans should never be forced to pay a tax to defend themselves, their families, or their homes. The Second Amendment doesn’t say “…shall not be infringed — plus 8.25% sales tax.”
If free speech were taxed, Americans would be outraged. If voting came with a fee, the courts would strike it down as a blatant poll tax. So why are politicians still getting away with taxing our right to keep and bear arms?
Gun rights are under attack at the federal level every day — but Texas can set the standard by ending the sales tax on firearms, ammunition, and accessories once and for all.
Add your name to the petition demanding Texas lawmakers END the Second Amendment poll tax NOW!
And if you’re able, please consider chipping in $10 or even $50 to help Texas Gun Rights continue fighting for you in Austin and in Washington!

Chris McNutt
